PACK 4 TRAVEL TERMS & CONDITIONS

 

Pack 4 Travel (also referred to as the Company herein in this document) wants you to enjoy your travel with us with 100% success. The following conditions are your contract with Pack 4 Travel, so please read them carefully. When you book a trip with us, you agree to be bound by these Terms and Conditions that outline our various policies, including cancellations and liability. These conditions affect your rights and establish the governing law and forum for resolving any disputes that may arise. From the date of your first inquiry, the quote that we give you will be valid for 90 days. Any questions at all about your holiday, booking procedures, or conditions of sale, please contact Pack 4 Travel as we would be more than happy to help you. Quotes do not apply to your international flights from your home to South America and returning or within South America itself. Because these prices are constantly changing, these quotes are only valid for a short number of days and on some occasions only one day. Once a flight is quoted, it must be purchased and paid for on that day the ensure the validity of the quote. Our prices do not include international flights to and from South America, international airport taxes, meals not specified in the itinerary, personal expenses, personal insurance, tips and baggage porterage.

To secure a booking with Pack 4 Travel, the Client must deposit 30% of the entire price of the trip (minimum US$200). All flights (domestic and international) must be paid 100% in advance to secure spaces. 50% deposit for Trek packages. The deposit is non-refundable. Clients booking by telephone, fax or email will be deemed to have read the booking conditions. A booking is accepted and becomes definite from the date Pack 4 Travel has received the deposit from the Client. It is at this point that a binding contract between Pack 4 Travel, and the Client comes into existence. The contract is made between Pack 4 Travel, and the Client, which includes all persons named on the booking form. The person signing (submitting) The booking form warrants that he/she has full authority on behalf of all the persons whose names appear thereon and confirms that all such persons are fully aware of and accept these conditions.

The balance of the amount due must be paid to Pack 4 Travel no later than 30 days before departure . In case of non-payment of the balance by the due date, Pack 4 Travel will treat the booking as canceled by the Client. In the case of bookings made within 30 days of the departure date, the full amount of package price has to be paid at once. Payment can either be made by Credit Cards, Paypal, wire transfer or direct deposit, Visa , Master Card,American Express In case of a bank transfer, all wiring and transfer costs should be assumed by the Client. All prices are United States of America Dollar based. Our prices do not include Peruvian sales taxes. Those exempt from paying this tax must meet the legal standards. For an exemption from the IGV (General Sales Tax) the visitor (guest) must prove he or she meets the international treaty standards honored in Peru by showing a passport, driver’s license or national identity card. Please note that visitors who have stayed in Peru longer than 60 calendar days are no longer exempt from IGV (General Sales Tax). Also please make sure that your identity documents are legible and note that the TAM (Andina Migration Card) cannot substitute a passport.

The final payment has to be paid 30 days before the departure date, if you have a local payment scheduled it has to be recieved in full USD cash upon arrival on day 1 of your tour. If this local payment is not paid, Pack 4 Travel will cancel your booking and cancellation charges will apply. (See Section 5. Cancellation by you).

Some of our tours involve a local payment as the final payment of your tour. This payment, in USD$ cash is to be paid to our representative on day 1 of your tour upon arrival at your accommodation. Full information on your local payment is outlined with the price in your quotation, website, and all of our invoices. This local payment is considered part of your total tour payment and is non-refundable.

Any changes to the original booking must be confirmed by the person signing the booking form. For any change by the Client to the itinerary after receiving a confirmed Travel Program from Pack 4 Travel, a US$10 changing fee will be charged plus any costs or charges which are incurred or levied by our suppliers as a result of the amendment. While every reasonable effort will be made to accommodate changes and additional requests, their availability cannot be guaranteed.

If any member of your party is prevented from traveling, it may be possible to transfer the booking to another suitable person, provided that written notice is given at least 30 days prior to departure. An administration fee of US$50 will be levied plus any costs imposed by Pack 4 Travel (it can not be possible in reservations or packages that have services Inca trail)

The Client may cancel the booking at any time provided that the cancellation is communicated to Pack 4 Travel in writing. Deposit paid to reserve trip is non-refundable. Payments for flights, and Inca Trail bookings are non-refundable due to airline and policies culture Ministry; Peruvian state that grants the allowed income according to regulation. All other reservations cancelled less than 45 days prior to the departure date of the tour are subject to the following cancellation fees: Period before departure when written notification is received Cancellation fee as a percentage of the refundable 60 and more days before departure: 50% of total price (initial payment + final payment) 59 to 30 days before departure: 60% of total price (initial payment + final payment) 29 days to 14 days before departure: 90% of total price (initial payment + final payment) Less than 14 days: 100% of price (initial payment + local payment)

While Pack 4 Travel will use its best endeavors to operate all tours as advertised, by entering into this contract the Client accepts that it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions. Pack 4 Travel reserves the right to cancel or change any of the facilities, services or prices (including flights, accommodation or other arrangements) at any time and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes. If a major change is known to us at the time of the booking, the Client will be informed immediately. If a major change becomes necessary after booking, Pack 4 Travel will inform the Clients as soon as reasonably possible. When a major change is made, the Client will have the choice to accept the change of arrangements, to purchase any other available tour or to cancel the tour and obtain a full refund. This is providing that the major change is not because of force majeure. Force majeure is war, threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline, train, transport type, or other similar events beyond the control of Pack 4 Travel. Pack 4 Travel is not liable for any charges in the event of a change – beyond their control – to the departure time or date of a tour, flight or other forms of transport.

Should any price increase, Pack 4 Travel will absorb the price increase if the price increase is less than 2% of the total package price. If the increase is more than 2%, the client will be surcharged the difference.

It is the responsibility of the Client to be in possession of a valid passport, visa permits, inoculations, and preventative medicines as may be required by the authorities of the visited countries for the duration of the tour. Information about these matters or related items is given in good faith but without responsibility on the part of Pack 4 Travel.

All Clients are expected to assess that their physical fitness aligns with the requirements of the itinerary of their choosing prior to booking. Travelers with pre-existing medical conditions are advised to check with a healthcare professional before traveling on the chosen itinerary. No unaccompanied minors (those under 18 years of age) can be accepted on tours operated by Pack 4 Travel however older teenagers may be considered provided they are accompanied by a parent or guardian who accepts full responsibility for the minor. Pack 4 Travel reserves the absolute right to decline a booking at their discretion. Clients agree to accept the authority and decisions of the employees of Pack 4 Travel, tour leaders and agents, while on the tour with Pack 4 Travel. If the health or conduct of a Client before or after departure appears likely to endanger the safe, comfortable or happy progress of a tour, the Client may be excluded from all or part of the tour. In case of ill health Pack, 4 Travel may make such arrangements as it sees fit and recover the costs thereof from the Client.

All participants in tours operated by Pack 4 Travel are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve Pack 4 Travel of all obligations that they may otherwise have under these booking conditions.

Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment that may be required during the tour. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the tour in which case all money paid will be forfeit. If the chosen holiday includes excursion or transfer by boat of any sort, the Client must make it known at the time of booking if he/she is unable to swim. This will not prevent the Client from participating in the tour but will enable Pack 4 Travel to take additional precautions for the safety of the Client at such times as may be appropriate.

If the Client has a complaint about any of the tour arrangements, he/she must bring it to the attention of the tour leader or other representatives of Pack 4 Travel at the appropriate time so that they may use their best endeavors to rectify the situation. It is only if Pack 4 Travel is made aware of any problems that there will be the opportunity to put things right. Making your complaint known to Pack 4 Travel as a problem arises during your trip will allow us to remedy the situation or facilitate compensation. Should the problem remain unsolved, a complaint must be made in writing to Pack 4 Travel within 28 days of the completion of the holiday.

Pack 4 Travel will use its best endeavors to ensure that all flight prices are correct at the time that they are quoted. Airlines reserve the right to amend or withdraw fares without prior notice. Once a deposit is paid on an airfare, it guarantees that a booking is being held for you, but it DOES NOT GUARANTEE the fare. The fare can only be guaranteed when the flight booking has been paid in full and a ticket has been issued. Flight bookings cannot be transferred. The flight times given by Pack 4 Travel are for general guidance only and are subject to change. Up-to-date flight times will be shown on the tickets. The Client must check the tickets very carefully immediately upon reception of the latest timings. Pack 4 Travel will endeavor to inform the Client as soon as possible in the event of any flight alteration. Details of airlines are also subject to change. Such alterations do not constitute a significant change to the trip arrangements and will therefore not be entitled to cancel without paying the normal charges as a result. Pack 4 Travel cannot be held responsible for any delay to your flight whether this delay is caused by adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, the rescheduling of flight times by the airline, mechanical breakdown, strike, industrial action or any other reason.

Inca Trail permit availability will be reflected on our website under individual trip departure dates. The rules and regulations controlling the Inca Trail and Machu Picchu are continually changing and it is important to be aware of the issues detailed in this document before embarking on your adventure to Peru. No more than 500 people per day are allowed to start the Inca Trail trek at km. 82. This number includes all support staff (ie. porters, cooks and guides) and is very tightly controlled. Once this limit of 500 people is reached, the Trail is effectively closed off for the day and no further bookings can be made. Reservations are not held on the Trail and all permits to trek must be bought as far as possible in advance with complete and correct passport information, to which no modifications can be made. Any attempts at modifications result in a loss of the permit and any money paid. Bookings made 65 days or more before the Inca Trail portion* of any Pack 4 Travel should proceed without any issue if we receive the following pieces of information: Full name (exactly as it appears on the passport, see Important Note for further details) Date of Birth Nationality Passport Number (of the passport you will be using to travel, see Important Note for further details) Date of Passport Expiry – Must be valid for a least 6 months past the date of travel. Bookings between 64 and 31 days before the Inca Trail portion of any tour will be taken on a request basis. Important Note: The passport number and name that is submitted to Pack 4 Travel, at time of confirmation, will be used to purchase the Inca Trail permit and entrance to Machu Picchu. This passport number and name will be used to identify yourself as you enter the checkpoint at the start of the trail and throughout the hike. If this information does not match the information you have submitted at time of confirmation, changes and corrections can be subject to fees as discrepancies can lead to being denied admission to the Inca Trail. Please note that these rules and regulations are strictly enforced by the governing bodies of the Inca Trail in Peru and are out of the control of Pack 4 Travel, meaning no exceptions can be made. If you are denied access on the Inca Trail as a result of providing incorrect or invalid information, cost of accommodation and other services during this time will be the responsibility of the individual and not Pack 4 Travel. Should any requests made within 64 days before the Inca Trail portion* of any tour be denied, the following three alternatives will be offered: In the unlikely event that we are unable to secure permits, the following options will be offered: Hike the Lares Trek route through the Sacred Valley, a fascinating and challenging 3-day, 2-night trip ending in Aguas Calientes and Machu Picchu. This trek takes in much of the Inca’s most sacred and important countryside and many monuments. All transportation, accommodation, guide services etc. will be included. Spend two nights in Cuzco, travel by train for a night in Aguas Calientes, and join the hikers for the tour of Machu Picchu. Cancel or change the trip without penalty If changes to the current government policy affect our ability to provide access to the advertised itinerary including the Inca Trail, we will endeavor to provide clients with the best options and customer service availables. *When booking any trip involving the Inca Trail, please book as far in advance as possible in order to increase the possibility of securing space on the Trail during the peak periods of the year. Machu Picchu Entrance Regulations The Peruvian government allows visitors to enter Machu Picchu for a maximum of 4 hours (either from 6am – 12pm or 12pm – 16:00pm) All visitors are required to be accompanied by a guide — all Pack 4 Travel tours visiting Machu Picchu include a guided visit Please refer to the Important Note regarding accuracy of information provided at time of booking as this information is used to purchase the entrance to Machu Picchu. Discrepancies may result in fees or denial of entry.
